Here's our situation. My spouse and children are covered on my HDHP plan. I have been maxing the HSA every year.
My spouse is starting a new job and has the option to join an HDHP with no premiums. Her employer will put $140 into her HSA every month.
Her new plan would have limited hospitals in network including her current doctor. I want to leave her on my plan as well. Her plan would be the primary plan and my plan the secondary.
Would her staying on my plan preclude her or her employer contributing to her HSA?
I reviewed pub 969 and felt like I could read it either way. One of the requirements for qualifying to contribute to an HSA is as follows:
You have no other health coverage except what is permitted under Other health coverage, later.
It defines other health coverage as:
Other health coverage. If you (and your spouse, if you have family coverage) have HDHP coverage, you can’t generally have any other health coverage. However, you can still be an eligible individual even if your spouse has non-HDHP coverage, provided you aren’t covered by that plan.
