So I thought this might help others who may have a fraudulent or stolen check.
We paid our property taxes in November 2023 in full and the check cleared about 10 days later from our checking account. Then the first week of June 2024 our count tax assessor sent a automated letter Notice of delinquent property taxes. We printed out the image of the cashed check (front and back) $5877.45 pay to the order of Yamhill county tax assessor with our 6 digit account number on it.
The wife took it to the assessor's office, they said we did not cash this and you owe us another check plus late fees. (no county stamp on the image) Wife then goes to our credit union shows them the check image and the letter from the county. They verify it was not cashed by the county but was cashed for actual cash at a quick pay day type of place. Credit union then said we cover check fraud and replaced the $5877.45, so wife went back and paid the county in person.
Then 3 days later the credit union reversed the credit and said the rules for check fraud only allow if reported with in 60 days. Nov- June is 7 months. According to google this is industry standard.
The wife and I go to the credit union and sit down with #3 since branch manager was unavailable. I show her the check image and ask: when I balance my checking account in November and see this has cleared (payee is not washed) I have done my due diligence. You work here can you tell this has been stolen while reconciling your account? We think our 60 days begins in June with the late notice from Yamhill county. She agreed and was going to escalate this to the main branch. The end of August we got the money refunded.
They could not tell us how or where this happened and that the credit union is taking the loss. Normally we do bill pay, this time it was a check. We don't put outgoing mail in the mail box over night, we put it out a few hours before the mailman comes. It could have been taken from our mailbox at the street or postal worker or county worker. At busy times of the year counties and post offices hire temporary workers which have been caught stealing.
