Hi all
I have just realized that the UK charges CGT even while I am a non-resident if I go back there. quite interesting.
So, I have been UK tax resident for 4 years out the 7 before UK departure, I am UK non-resident now, and I might go back within 5 years. If I do that, I will be temporary non-resident so will pay capital gains tax on any capital gain, be it from foreign or UK source, just like I was a UK tax resident (and assuming I bought the assets before I left the UK, which I did). Sure, no problem!
Now, I was reading here: https://www.gov.uk/government/publicati ... s-tax-2024
And at the very end it says that 'offshore income gains' are also taxable. Then I look for the definition of offshore fund and ETFs (reporting or not) are included in the definition of 'offshore funds' => https://www.gov.uk/hmrc-internal-manual ... s/ifm12282
Am I understanding correctly then that all the interests/dividends from Ireland UCITS ETF I have held during the period of temporary non-residence are taxable in the UK in the year I return, so long that the year I return is within 5 years of my departure?
I find this more surprising than the CGT, hence I am asking.
(let's ignore double treaty for the sake of this)
